4.4.1 Proposals for Significant Change

Under the Education Regulations 1995, a school is required to inform the Schools Registration Board of any significant changes relating to its registration:

5. (1) A registered school must notify the Registration Board, by notice in writing, of any significant changes in relation to any specified matter after registration or renewal of registration is granted.

In order to approve the change, the Schools Registration Board may require a review to be carried out, depending upon the nature of the changes.

A proposal for a change to the registration details of a school should be made to the Board no later than six (6) months before the intended date on which the change is to take place. During that time the Board would need to be satisfied that the proposed change would comply with the Minister's standards (Education Act 1994 54-1).

A significant change would include such events as:

  1. the closure or amalgamation of a registered school with any other school
    1. a change in the authority responsible for the governance of a school;
    2. a change in the structure and nature of governance of a school
  2. the change of name of a school;
  3. a decrease in the school’s financial capacity to continue operations;
  4. changes to a school's operation by way of relocation, opening an additional campus, or amalgamating campuses; and
  5. a change in the year levels offered (e.g. extending an existing primary school to include a secondary level).

4.4.1.1 Application

The proposal to registration details should be set out in the form Application to Change Existing School Registration Details also available from the Schools Registration Board office.

 

4.4.1.2 Approval Process

The officers of the Schools Registration Board shall prepare a report based on this information, indicating whether or not a change to the type of registration under Section 54 of the Act is involved, and whether the proposed change/s might affect the Board’s determination of renewal of registration.

    54—If the Registration Board grants an application for registration as a school,  it is  to register that school as a school of a type providing one or more of the  following:

  1. primary education for any specified ages,

  2. secondary education for any specified ages,

    1. distance education

  3. education of a specified kind;

  4. education for children of a specified kind.

The officers' report shall be considered by the Board and the Board shall decide whether or not a review and subsequent renewal of registration should be undertaken, and whether the registration the school should be amended. Any review and subsequent determination of registration would be undertaken according to the procedures for review of registration described above.

4.4.2 Notifiable Changes

There are other notifiable changes about which a school is required to inform the Schools Registration Board. Generally such changes would simply be noted in the Board's records, however the Board need to be notified in order to consider whether such a change might affect the Board's determination of renewal of registration.

Notifiable changes would include any that relate to the matters specified in Section 53-(1) of the Act.

  1. the curriculum, especially any changes to the method of offering the curriculum
  2. significant variations to the registration status of number of teachers at a school
  3. the facilities provided at a school;
  4. large variations to the number of students attending a school;
  5. the kinds of students attending a school, other than changes to year levels; and
  6. the enrolment and attendance procedures of a school.

The notification of changes shall be in writing and must give:

  1. full details of the change;

  2. details of how the change may affect the operation of the school; and
  3. advice on whether the change alters the type of education the school is providing.

4.4.3 Schools to Provide an Annual Return

The Schools Registration Board will contact each school in annually to request that the school’s current registration details be confirmed or updated. This should assist schools in keeping the Board informed of adjustments to school details.
