4.5 Other InstitutionsŽ Kindergartens and Pre-schools Although the Act does not contain a specific reference to Kindergartens, the Solicitor-General of Tasmania has determined that an organisation which provides educational instruction to children of less than compulsory school age falls within the definition of “school” and is required to be registered under Part 5 of the Education Act 1994. On the basis of this advice, the Board views Kindergartens as schools providing “education of a specified kind” as in Section 54–(c) of the Education Act 1994 under which the Board may;
A school that is providing a program for children who are less than four years of age on 1st January in the year of starting school will have to demonstrate that the school meets childcare licensing requirements under the provisions of the Child Care Act 2001. 4.5.2 Home EducationA parent of a school-aged child may apply to the Minister for Education for registration as a home educator (Section 17). The Home Education Advisory Council assists in the management and support of home education in Tasmania. The role of the Advisory Council is to provide advice and information to the Minister in relation to home education. It has responsibility for monitoring individual home education programs and provides a reference point for queries, responds to community concerns and maintains liaison with other agencies about home education. Students enrolled at a school registered to provide education to meet the compulsory education requirements of the Act by correspondence or distance education may not also be registered as students receiving Home Education. If the school provides assistance or tuition to students registered for home schooling by the Home Education Advisory Council, those students may not be counted in the enrolment of the school.
